EB2 NIW (National Interest Waiver) 

The EB2 NIW (National Interest Waiver) is an employment-based U.S. immigration category that lets highly skilled professionals and exceptional-ability individuals apply for a Green Card without an employer sponsor. EB2 NIW falls under the EB-2 category but waives the job-offer and labor certification (PERM) requirements when granting the waiver is in the national interest of the United States. 2) National Interest Waiver (the “NIW test”)

  3. On balance, it benefits the U.S.to waive the job offer and labor certification requirements.
